TuProfesional.xyz (hereinafter, "the Platform") is a marketplace that connects customers with independent professional home service providers in the Valencia region, Spain. The Platform acts solely as an intermediary and does not directly provide any professional services.
2. Acceptance of Terms
By accessing or using the Platform, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the Platform.
3. Customer Usage
Customers may use the Platform's contact form free of charge to request information or quotes from service providers.
- Submitting a contact form does not guarantee a response from the provider within a specific timeframe.
- TuProfesional is not responsible for the quality, timeliness, or outcome of services provided by the providers.
- Contact data submitted is shared with the corresponding provider(s) to facilitate the connection.
4. Provider Obligations
Providers registered on the Platform agree to:
- Provide truthful, accurate, and up-to-date information in their profile.
- Respond to received leads in a timely and professional manner.
- Maintain an active subscription to appear in search results pages.
- Comply with all applicable legislation in the provision of their services.
- Not use the Platform for fraudulent, deceptive, or illegal activities.
5. Subscriptions and Payments
- Provider subscriptions are monthly and recurring, processed through Stripe.
- Providers may cancel their subscription at any time from their dashboard.
- Upon cancellation, the booked position remains active until the end of the current billing period.
- No refunds are issued for partial unused periods.
- TuProfesional reserves the right to modify prices with 30 days' notice.
6. Lead Quality Disclaimer
TuProfesional does not guarantee the quality, quantity, or conversion rate of leads received by providers. Leads come from real users who submit the contact form, but the Platform cannot guarantee that each contact will result in a contracted service.
7. Intellectual Property
- Platform: TuProfesional owns all intellectual property rights over the Platform, including its design, source code, logos, and editorial content.
- Providers: each provider retains ownership of the content they upload to their profile (logos, descriptions, photographs).
- Providers grant TuProfesional a non-exclusive license to display their content on the Platform for promotional purposes.
8. Limitation of Liability
TuProfesional acts exclusively as a marketplace that facilitates connections between customers and providers. Accordingly:
- We are not a party to any service contract between customers and providers.
- We assume no liability for damages, losses, or harm arising from services provided by the providers.
- We do not guarantee uninterrupted availability of the Platform.
- Our maximum liability is limited to the amount paid by the provider in the 12 months prior to the event giving rise to the claim.
9. Account Suspension and Termination
TuProfesional reserves the right to suspend or terminate the account of any provider who breaches these terms, provides false information, or misuses the Platform, with prior notice when reasonably possible.
10. Modification of Terms
TuProfesional may modify these Terms of Service at any time. Material changes will be notified to registered users with a minimum of 30 days' advance notice. Continued use of the Platform after the changes take effect implies acceptance of the new terms.
11. Governing Law and Jurisdiction
These Terms of Service are governed by Spanish law. For the resolution of any dispute arising from the use of the Platform, the parties submit to the Courts and Tribunals of Valencia (Spain), unless consumer protection regulations establish a different jurisdiction.
